Terms of Service

1. Acceptance of Terms

By creating an account or using Agentype ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and Agentype.

2. Description of Service

Agentype is a SaaS platform for real estate professionals. It provides tools for lead management, AI-assisted follow-up email drafting and sending, listing copy generation, and property viewing scheduling through integration with Google Gmail and Google Calendar.

3. Accounts and Eligibility

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.

4. Free Trial and Subscriptions

• New accounts receive a 14-day free trial with full access to all features.
• After the trial period, continued access requires a paid subscription.
• Subscriptions are billed on a recurring basis (monthly or annually) via Stripe.
• You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods.

5. Acceptable Use

You agree not to:

• Use the Service to send spam, unsolicited bulk email, or harassing messages.
• Violate any applicable laws or regulations, including anti-spam laws (CAN-SPAM, CASL, GDPR).
• Attempt to gain unauthorized access to the Service or other users' accounts.
• Use the Service to store or transmit malicious code.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Resell or sublicense access to the Service without our written consent.

6. Google Integration

The Service integrates with Google Gmail and Google Calendar via OAuth 2.0. By connecting your Google account, you authorize us to send emails and read calendar events as described in our Privacy Policy. You may revoke this access at any time through your Google Account settings. We are not affiliated with Google LLC.

7. Your Data

You retain ownership of all data you upload or create within the Service (leads, listings, notes, etc.). By using the Service, you grant us a limited license to process your data solely to provide the Service, including sending relevant data to third-party AI providers to generate content on your behalf as described in our Privacy Policy.

Upon account deletion, your data will be permanently removed from our systems within 30 days.

8. AI-Generated Content

The Service uses third-party AI services (currently Google Gemini) to generate email drafts, listing descriptions, viewing invitations, and lead-listing matching. When you use these features, relevant data from your account (lead names, emails, notes, listing details) is sent to the AI provider for processing.

You are solely responsible for reviewing, editing, and approving any AI-generated content before it is sent or published. We make no guarantees about the accuracy, tone, or appropriateness of AI-generated content for your specific use case.

9. Intellectual Property

The Service, including its design, code, and branding, is owned by Agentype and protected by intellectual property laws. Nothing in these Terms grants you any ownership rights in the Service.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Your use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Agentype shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunities. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice within the application at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
